TERMS AND CONDITIONS OF SALE – DANSE FLOOR SARL

ARTICLE 1 – SELLER’S IDENTITY AND PURPOSE

These Terms and Conditions of Sale (T&C) govern sales made on the website boutique.danse-floor.com by:

These GTC apply exclusively to individual consumers acting for non-professional purposes.

Any order implies full and unconditional acceptance of these GTC.

Danse Floor SARL reserves the right to modify these Terms and Conditions at any time. The applicable Terms and Conditions are those in effect on the date of the order.

ARTICLE 2 – PRODUCTS

The essential characteristics of the products are presented on the website with the greatest possible accuracy.

Photographs, visuals, descriptions, and colors are provided for illustrative purposes only and cannot guarantee a perfect match with the delivered product, particularly due to display differences depending on the screens used.

The customer is solely responsible for the selection of the products ordered and must verify their suitability for their needs before confirming the order.

Danse Floor SARL reserves the right to:

  • modify its product range;
  • withdraw a product from sale;
  • limit available quantities;
  • or cancel a sale in the event of exceptional unavailability.

In the event of unavailability after an order is placed, the customer will be notified as soon as possible and receive a full refund.

ARTICLE 3 – ORDERS

The customer may place an order:

  • directly via the website;
  • with or without creating a customer account.

The customer account provides access to order history and delivery information. The customer is responsible for maintaining the confidentiality of their login credentials and password.

Before final confirmation, the customer may review the order details and correct any errors.

The order becomes final after:

  • payment confirmation;
  • and the sending of a confirmation email.

Danse Floor SARL reserves the right to refuse, suspend, or cancel any order in the event of:

  • a prior dispute;
  • fraud or attempted fraud;
  • suspicion of misuse;
  • non-payment;
  • or an abnormal request.

The data recorded by Danse Floor SARL’s computer systems constitutes proof of the transactions carried out.

ARTICLE 4 – PRICES

Prices are listed in euros, including tax.

Shipping costs are indicated before final confirmation of the order.

Danse Floor SARL reserves the right to modify its prices at any time; products are billed at the rate in effect at the time of the order.

Despite the care taken with the website, an exceptional pricing error may occur. In this case, the customer will be notified before shipment and may cancel their order at no cost.

An invoice may be provided upon request.

ARTICLE 5 – PAYMENT

Payment is due immediately upon placing the order.

Payments are made by credit card or any other method offered on the website via a secure platform using SSL and 3D Secure protocols.

Danse Floor SARL does not store any banking data.

In the event of a declined credit card authorization or a payment issue, the order will be automatically canceled.

Danse Floor SARL reserves the right to request certain proof of identity or proof of address to prevent fraud.

ARTICLE 6 – DELIVERY

Products are delivered to the address provided by the customer at the time of ordering.

Deliveries are made by independent carriers contracted by Danse Floor SARL.

Delivery times are estimates and may vary depending on:

  • the destination;
  • peak periods;
  • logistical constraints;
  • or events beyond the control of Danse Floor SARL.

In accordance with the Consumer Code, if delivery is delayed by more than 30 days after the order is placed, the customer may request cancellation and a refund of their order.

The customer must check the condition of the package upon receipt.

Any issue (damaged package, missing item, order error, damaged product) must be reported within 7 days via email to contact@danse-floor.fr with supporting documentation and photographs.

Risk passes to the customer at the moment they physically take possession of the products.

ARTICLE 7 – RETENTION OF TITLE

The products remain the property of Danse Floor SARL until full payment of the order has been received.

ARTICLE 8 – RIGHT OF WITHDRAWAL

In accordance with legal provisions, the customer has a period of 14 days from receipt of the products to exercise their right of withdrawal without having to provide a reason.

The request may be made:

  • by email;
  • by mail;
  • or via the withdrawal form provided at the end of these Terms and Conditions.

The products must be returned:

  • complete;
  • unused;
  • clean;
  • and in their original packaging, allowing them to be resold.

Incomplete, damaged, or soiled products cannot be refunded.

Return shipping costs are the customer’s responsibility.

The refund will be issued within a maximum of 14 days after receipt and inspection of the returned products.

The refund may be issued:

  • via the original payment method;
  • by bank transfer;
  • or as a store credit with the customer’s consent.

ARTICLE 9 – LEGAL WARRANTIES

The products are covered by:

  • the legal warranty of conformity provided for in Articles L217-3 et seq. of the Consumer Code;
  • the warranty against hidden defects provided for in Articles 1641 et seq. of the Civil Code.

In the event of a defective or non-conforming product, the customer may request:

  • repair;
  • replacement;
  • or a refund for the product in accordance with applicable legal provisions.

The warranty does not cover:

  • normal wear and tear;
  • misuse;
  • improper use;
  • lack of maintenance;
  • damage caused by accident, negligence, or modification of the product;
  • the consequences of improper storage.

Return shipping costs may be reimbursed upon presentation of proof, limited to standard shipping rates.

ARTICLE 10 – LIABILITY

Danse Floor SARL shall not be held liable for:

  • indirect damages;
  • temporary inability to access the website;
  • internet network disruptions;
  • delays attributable to carriers;
  • or cases of force majeure.

Danse Floor SARL’s liability is limited to the amount of the order in question.

The customer is solely responsible for the use of the purchased products.

ARTICLE 11 – FORCE MAJEURE

Danse Floor SARL shall not be held liable for the non-performance of its obligations in the event of force majeure as defined in Article 1218 of the Civil Code.

The following are notably considered cases of force majeure:

  • natural disaster;
  • fire;
  • strike;
  • pandemic;
  • administrative closure;
  • major computer failure;
  • exceptional disruption of transport or supply networks.

ARTICLE 12 – PERSONAL DATA

The personal data collected is necessary for:

  • order processing;
  • delivery;
  • billing;
  • after-sales service;
  • and customer relationship management.

The data is processed in accordance with the General Data Protection Regulation (GDPR).

It is retained for the period necessary to fulfill the purposes of processing and to meet legal obligations.

The data is never sold to third parties without prior consent.

The customer has the following rights:

  • access;
  • correction;
  • deletion;
  • objection;
  • restriction;
  • portability.

ARTICLE 13 – INTELLECTUAL PROPERTY

All elements of the website (text, images, logos, videos, graphics, documents, visuals, trademarks) are protected by intellectual property law.

Any reproduction, in whole or in part, without prior written authorization is prohibited.

ARTICLE 14 – MEDIATION AND DISPUTES

In the event of a dispute, the customer is invited to contact Danse Floor SARL first in order to seek an amicable solution.

In accordance with the French Consumer Code, the customer may have recourse to the following mediator free of charge:

In the absence of an amicable agreement, the French courts shall have exclusive jurisdiction.

ARTICLE 15 – GOVERNING LAW

These Terms and Conditions are governed by French law.

If any provision of these Terms and Conditions is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
